中世纪著名的神学家、哲学家,“自然神学”的提倡者之一,托马斯·阿奎那(St. Thomas Aquinas,約1225-1274)根据当时的教皇格列哥里九世授意而写出的《神学大全》,是中世纪的百科全书。阿奎那搬用了亚里士多德理论,从不同的角度论证上帝存在。 罗吉尔·培根(Roger Bacon,1214-1294,英国方济各会修士、哲学家)反对阿奎那的正统经院哲学,他持唯名论的观点。他要证明:个体的存在是绝对的无条件的。他还认为,中世纪获得真理面临重重障碍,第一个障碍就是无根据地崇拜权威。 另一位邓斯·司各脱(Blessed John Duns Scotus,约1265-1308),苏格兰中世纪时期的经院哲学家、神学家、唯名论者。他提出的“神学和哲学各司其职”为后来著名的“奥卡姆剃刀”铺平了道路。 奧卡姆的威廉(William of Ockham/Occam,約1285-1349),14世紀逻辑学家,英国圣方济各会修士。他所主张的“思维经济原则”,概括起来就是“如无必要,勿增实体”。后来人们把这句话称为“奥卡姆剃刀”。 这把剃刀出鞘后,剃秃了几百年间争论不休的经院哲学和基督神学,使科学、哲学从中宗教分离出来,引发了欧洲的文艺复兴和宗教改革,科学革命,最终促成政教分离。 奥卡姆主张“君主立宪”,他认为:人人平等与王权有何相干”、“自然人通过人类社会共同契约建立起国家,国家仅仅是依法行事,契约保证人人享有幸福。”
<六>,当人的自然权利逐步以法律的形式得以确立,其普世性也得以实现。这种以“天赋人权”为基准,慢慢演化出来的制度,也慢慢地呈现出其合理性。 1215年6月,英格兰国王约翰(John,1166--1216)被迫赞成反叛贵族提出的“男爵法案”(Articles of the Barons)。这份协议最终塑造了现代文明社会的司法体系、民主,甚至是我们今天所说的自由。这就是被后人誉为“现代民主基石的“大宪章”(Magna Carta)。 1679年英国颁布的《人身保护法》(habeas cor—pus)其目的,就是限制国王及其臣属的专横行为,使他们不得任意处置反政府人士。 18世纪后期,英国普通法全面确立了陪审--抗辩制,无罪推定原则,沉默权原则和控方举政义务等。英国人认为,他们的司法改革,正是对人格尊严的守卫,其实是对古罗马的独立人格之更高形式的复兴。 英国法学家梅特兰认为,英国法发展史的特点是:最初“只代表大人物利益的法律,后来逐渐代表所有人利益的法律。
